Rainmaker Pty Ltd operates the MicroFog online store at microfog.co.za. In these terms, “MicroFog”, “we”, “us” and “our” refer to Rainmaker Pty Ltd, the seller of the products ordered from us.
Business address: Fourways, Johannesburg, South Africa. Company registration number: 2019/050165/07. Orders and enquiries: Sales@microfog.co.za. Website: https://microfog.co.za.
These terms govern use of our online store and purchases from Rainmaker Pty Ltd. The Consumer Protection Act 68 of 2008 (CPA) and Electronic Communications and Transactions Act 25 of 2002 (ECTA) apply where the purchaser and transaction fall within their scope. Nothing in these terms excludes a mandatory legal right. Our Privacy Policy is available on microfog.co.za; section 9 below sets out returns and refunds (see also our Refund and Returns Policy). Please read and save these terms before ordering. Accepting these terms is not blanket consent to personal-information processing.
1. Eligibility and accounts
You must have legal capacity to enter the transaction and authority to act for any business you represent. Where assistance from a parent or guardian is legally required, that assistance must be obtained. Provide accurate order details, protect your account credentials and notify us of suspected unauthorized access. Your responsibility for your account remains subject to our own legal and security duties.
2. Placing and accepting orders
Before submitting an order, review the products, quantities, delivery details, full cost and payment method. Our checkout must allow you to review the transaction, correct errors and withdraw before placing the order. Submitting an order is an offer to purchase. A sale is concluded when we communicate acceptance through email. An automated message that merely acknowledges receipt, and is clearly identified as such, is not acceptance. Contact Sales@microfog.co.za promptly if you identify an error after submission.
We may decline an order before acceptance for lawful reasons such as unavailable stock, failed payment or reasonably suspected fraud. We will notify you and return payments due. We will not substitute a product without your agreement. Cancellation after acceptance requires a lawful basis and does not remove your remedies.
If ordered goods are unavailable, we will immediately notify you and refund payments within the applicable statutory period, including within 30 days of that notification where ECTA section 46 applies. Where CPA section 47 applies, its additional remedies, including prescribed interest and qualifying directly incidental costs, remain available, subject to its statutory conditions and exceptions. We will not substitute another product without your agreement.
3. Prices and payment
Prices are stated in South African rand (ZAR). VAT status and price treatment: VAT registered, prices include VAT. The full payable price, including applicable taxes, delivery and other charges, is disclosed before you submit your order. Available payment methods are EFT or Card. Do not send card security codes, PINs or full card details by email.
Prices and availability may change for future orders. Changes do not retrospectively alter an accepted order. Pricing errors will be handled in accordance with applicable law, including rules for displayed prices and obvious errors. We will not charge a higher price without your agreement and will refund payments where a transaction is lawfully cancelled.
Any bulk-order quotation, deposit or instalment arrangement must be expressly agreed in writing before purchase, including the payment schedule, delivery arrangements and cancellation terms. A deposit is not automatically non-refundable. Where CPA section 17 applies, cancellation of an advance order is subject only to a reasonable cancellation charge permitted by that section and its exceptions.
4. Delivery and order records
Delivery territories: South Africa. The normal timeframe is 7–10 working days for dispatch or delivery, starting from payment received. The applicable timeframe must be disclosed before purchase. If stock is unavailable or a longer lead time is required, we will notify you and obtain agreement to revised arrangements without removing your statutory cancellation or refund rights. Delivery is by courier. Delivery charges and calculation: these arrangements and the full charge are disclosed before purchase. A different lead time or delivery arrangement for a bulk or special order must be agreed before purchase. Delivery is to the address agreed for the order. Contact Sales@microfog.co.za for assistance.
We will assist with missing, damaged or delayed parcels and liaise with the courier. Where the Consumer Protection Act 68 of 2008 (CPA) applies, goods remain at risk until delivery is accepted as provided by law. Referring you to a courier does not remove our statutory obligations. We will honour applicable cancellation, replacement or refund remedies for non-delivery or delay.
Where the Electronic Communications and Transactions Act 25 of 2002 (ECTA) applies, we must execute the order within 30 days after receiving it unless another period is agreed. If we fail to meet that period, you may cancel with seven days’ written notice under ECTA, without limiting other applicable rights. Please provide an accurate delivery address and notify us of delivery problems promptly.
You may save or print these terms and retain your order confirmation and invoice. A full transaction record can be requested by emailing Sales@microfog.co.za for 2 years from delivery receipt. Customer access arrangements are distinct from statutory record-retention duties; our Privacy Policy explains retention and lawful exceptions.
5. Products and warranties
Product descriptions and instructions explain intended use, limitations and safety requirements. Follow the manufacturer instructions, product labels and applicable safety data sheets, including dilution, ventilation, protective equipment and compatibility requirements where relevant. Do not use a product for an unapproved purpose. These obligations do not excuse defective products, inadequate warnings or misleading descriptions.
Any contractual warranty terms must be available before purchase. They supplement statutory warranties and do not replace them. A manufacturer claim process does not remove applicable remedies against MicroFog. Section 9 explains how to report problems and exercise return rights.
6. Lawful use and website content
Do not misuse the website, attempt unauthorised access, introduce malicious software, commit payment fraud or submit unlawful content. Website text, images and branding belong to their respective rights holders. You may use the site for lawful browsing and purchasing, and to save transaction documents; other reproduction requires permission unless the law permits it.
We may restrict access reasonably to protect the website or address a material breach. This does not cancel outstanding delivery, refund or privacy obligations. We take reasonable care in operating the site, but availability may be interrupted for maintenance or events outside reasonable control.
7. Liability and disputes
Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable product liability, fraud or gross negligence.
Send complaints to Sales@microfog.co.za with your order details, a description of the issue and the outcome you seek. You retain access to competent consumer bodies, including the Consumer Goods and Services Ombud where it has jurisdiction (https://www.cgso.org.za/), the National Consumer Commission (https://thencc.org.za/), the Information Regulator for privacy matters (https://inforegulator.org.za/), and courts or tribunals under applicable procedures. These terms do not require compulsory private arbitration.
South African law governs these terms, subject to mandatory protections that apply. Updates apply prospectively. The terms applicable to an accepted order continue to govern it unless lawfully agreed otherwise. If a provision is invalid, the remaining provisions continue only to the extent legally permissible.
8. Returns and refunds
8.1 No discretionary refunds
MicroFog does not offer voluntary refunds for change of mind, ordering the wrong item or no longer needing a product. This restriction applies only when you have no legal right to cancel or return the goods. We honour all applicable statutory rights. We do not offer a general 30-day return period.
8.2 Online cooling off and legal exceptions
Where ECTA section 44 applies, you may cancel a goods purchase without giving a reason or paying a penalty within seven days after receiving it. You pay only the direct return cost, and we refund the payment within 30 days of cancellation. Applicable section 42 exclusions include genuinely personalised goods and goods that by their nature cannot be returned or deteriorate rapidly. Opening a disinfectant product does not, by itself, remove statutory rights; any exclusion must have a lawful basis.
Other legal cancellation or return rights remain available, including qualifying direct-marketing transactions, goods that do not match their description and applicable delivery or suitability claims. Where ECTA section 43 permits cancellation because required disclosures or checkout review facilities were omitted, you may cancel within 14 days after receiving the goods. You must return the goods, and we must refund all payments less the direct cost of returning them as that section provides. We will not apply an additional penalty for that cancellation. Other statutory claims are assessed under their applicable rules; the no-discretionary-refunds policy does not override them.
8.3 Defective or unsafe goods
Where CPA sections 55 and 56 apply, qualifying faulty, unsafe or defective goods may be returned within six months of delivery at our risk and expense, without penalty. You may choose repair, replacement or a refund as provided by law. We cannot require you to accept only a replacement or store credit. If within three months after a qualifying repair, the failure, defect or unsafe feature remains, or a further failure, defect or unsafe feature is discovered, replacement or refund rights apply under the CPA. These provisions do not limit any longer applicable warranty or other legal remedies.
Damage caused by misuse, unauthorised alteration or use contrary to instructions will be assessed on the facts and applicable law. Such circumstances do not automatically defeat an unrelated valid defect claim.
8.4 How to request assistance
Contact Sales@microfog.co.za with your order number or other proof of purchase, the issue and your requested remedy. Photographs can help where reasonably available. Report delivery damage or an incorrect item promptly, but failure to report it within an arbitrary short period does not remove statutory rights. Stop using a potentially unsafe product.
We will provide collection arrangements or the appropriate return address when you contact us. Contacting us helps arrange safe transport and does not make a statutory claim conditional on discretionary approval. Keep the goods and accessories safely, using original packaging if available or suitable protective packaging. Original packaging and unused condition are not blanket conditions for statutory defect claims. Do not send leaking or hazardous products through an ordinary courier without appropriate arrangements.
8.5 Return costs and payment
MicroFog bears qualifying defective-goods return costs. For other statutory returns, the applicable law determines costs and any permitted deduction. We do not levy a restocking fee on a CPA section 56 return or an ECTA section 44 cancellation. We will explain the legal basis for any permitted charge before applying it.
Refunds will be made to the original payment method, unless another lawful method is agreed with you. We will deduct delivery or return costs only where the applicable law permits. Qualifying defective goods returns under CPA section 56 are at our risk and expense, without penalty. For qualifying cooling-off cancellations under ECTA section 44, only the direct cost of returning the goods may be charged. Our processing target is 7 business days from receiving and inspecting the returned goods, subject always to any earlier statutory deadline. ECTA section 44 refunds must be made within 30 days of cancellation. Payment-provider delays do not extend our legal obligations. We will not require store credit instead of a legally required refund. Sections 2 and 4 above address unavailable orders and delivery failures. Escalate unresolved complaints to Sales@microfog.co.za or use the consumer channels in section 7.
